SEZ of Lipetsk region

It is necessary to develop the second investment wind not even to admit the appearance of the feeling of self-complacence, to define the new prospects, priorities. Today it is not enough to create an infrastructure for the attraction of investments, one requires a complex approach to develop of new sites. We need such investors who will offer the creation of nanoproducts, products of high technologies. That is, the second wind means new supermodern manufactures.

Federal special economic zone of industrial-productive type "Lipetsk"

On December 21, 2005, the Russian Government issued Order No. 782 to establish the Lipetsk industrial type special economic zone (Lipetsk SEZ) in the Gryazi District of Lipetsk region under the Federal Law "On Special Economic Zones in the Russian Federation".

As of July 01, 2012 there were 22 registered residents in the Lipetsk SEZ, including 6 residents with foreign ownership. Their total investments will exceed RUB 55 bn, with RUB 13.5 bn already invested and over 4,500 new jobs created.

Lipetsk SEZ has the entire infrastructure required.

Regional special economic zones

On August 18, 2006 the Lipetsk Regional Administration adopted Law No. 316-OZ "On Regional Special Economic Zones" (SEZ) which provides for the establishment and development of 8 regional SEZs, including 4 industrial, 1 agroindustrial, 2 tourism and recreational and 1 technical innovative special economic zones. The total area covered by the regional SEZs is 197 thousand hectares.

As of July 01, 2012, there were 40 registered members in regional SEZs. They create over 18,700 jobs and have a RUB 80 billion investments potential.

Total area of Special Economic Zones of Regional Level is 196 885 hectares.

Prospects for further development of regional special economic zones include:

  • increasing investments to RUB 240 bn;
  • increasing product output to RUB 63 bn;
  • increasing tax collected to RUB 6.8 bn;
  • creating 38 thousand new jobs.

Residents of regional SEZs enjoy tax incentives and other preferences granted for a 10-year period.

The Lipetsk Regional Administration has implemented the Investment Strategy of Lipetsk Region till 2020 to further improve the regional investment environment. This strategy aims to increase investment attractiveness of the region, create favorable environment for the mobilization of domestic investment resources and enhance inflow of external investment resources and innovative technologies to the regional economy, gain new sources of investments and increase their efficiency, develop regional infrastructure through private-public partnerships and reduce the gap between the levels of social and economic development of the regional districts and municipalities.

One of the tools for improving the Russian investment climate is industrial parks. One of such sites, Kuznetskaya Sloboda Industrial Park, has been created at Stroymash facilities in Lebedyan where Russian and foreign (Italian and German) companies are already operating successfully. Work is underway to create industrial parks in the territory of Gryazi and Usman Districts.

The Regional Administration has provided a legal framework for creation and functioning of industrial parks, including tax incentives for the companies operating in the industrial parks.

The Lipetsk Regional Administration has implemented the Investment Strategy of Lipetsk Region till 2020 to further improve the regional investment environment.

Regional Support of Investments Activities

The regional support of the branches of the economic complex to promote investment processes includes the following directions:

  • bank interest subsidies,
  • tax incentives,
  • government guarantees and provision of real property from the regional pledge fund,
  • direct regional financing.

Investors are provided with the following support in the Lipetsk Region:

  • reduction of income tax rate by 4.5 percentage points for 5 to 7 years;
  • exemption from property tax for 7 years;
  • exemption from transport tax for 10 years;
  • loan repayment guarantees by the Lipetsk Regional Administration;
  • property from the regional pledge funds to secure loan repayment;
  • bank interest subsidies to regional agricultural enterprises;
  • subsidies to cover expenses for exhibition areas at trade fairs organized in Moscow, other Russian regions and abroad;
  • SME subsidies to cover a part of loan interest and lease payments if the company carries out a high-priority investment project;
  • subsidies to cover a part of interest payments under investment loans made by Russian credit institutions and loans granted by agricultural consumer lending cooperatives;
  • subsidies to cover loan interest payments if the company carries out an investment project related to revival, preservation and development of traditional arts;
  • implementation of the one-stop shop principle for the residents of special economic zones.

In addition, the Lipetsk Regional Law "On Special Economic Zones of Regional Level" provides that the companies investing in infrastructure development (water supply, water disposal and waste treatment facilities) of the special economic zones are exempt from the property tax for 7 years from the property registration date provided that such property is located in the SEZ or adjacent territories and used for operations of the SEZ.

By decisions of local administrations, residents of regional special economic zones and the Lipetsk SEZ pay the land tax and rent at preferential rates.

Federal Law No. 116-FZ "On Special Economic Zones" dated July 22, 2005 defines the special economic zone as a territory within the Russian Federation designated by the Government of the Russian Federation and having specific business conditions.

Sole proprietors or companies are recognized as SEZ residents after they are included in the Register of SEZ Residents.

The industrial type SEZ resident may be any company, other than a unitary enterprise, which is registered under the Russian law in the municipality where the SEZ is located, and operating in such SEZ in the manner provided for by Federal Law No. 116-FZ "On Special Economic Zones" dated July 22, 2005.

The Department for Special Economic Zones and Project Financing with the Russian Ministry of Economic Development is responsible for legal regulation, creation and management of special economic zones in the Russian Federation.

An entity intending to become a resident of the SEZ files an application with the authorized governing body, Department for Special Economic Zones and Project Financing with the Russian Ministry of Economic Development, which includes:

  1. description of intended business operations in compliance with the SEZ type;
  2. land area required for intended operations of the applicant;
  3. estimated capital investments, including investments to be made within a year after the date of agreement to establish production in the SEZ. Each SEZ resident is obliged to make investments equivalent to three million euros (less intangible assets) at the exchange rate of the Bank of Russia as of the application date.

Together with the application, the applicant submits the following documents:

  1. a copy of the incorporation certificate;
  2. a copy of the tax registration certificate;
  3. a copy of constituent documents;
  4. a business plan in the form approved by Order No. 75 issued by the Russian Ministry of Economic Development on March 23, 2006;
  5. an unqualified opinion on the business plan expressed by the bank or credit institution in accordance with the criteria set out in Order No. 158 issued by the Russian Ministry of Economic Development on April 29, 2010.

Within ten business days after the receipt of the above mentioned documents, the Department for Special Economic Zones and Project Financing with the Russian Ministry of Economic Development takes one of the following decisions and informs the applicant thereof:

  1. to submit the application and business plan to the production type SEZ expert council;
  2. to refuse the application.

How to Become a Participant of a Regional SEZ

Lipetsk Regional Law No. 316-OZ "On Regional Special Economic Zones" dated August 18, 2006 (as amended on October 27, 2010) defines the regional special economic zone as:
a territory with fixed borders (except for tourist, innovative and agricultural zones) offering a favorable environment for businesses.

An entity intending to become a resident of any regional SEZ files an application with the authorized governing body which includes:

  1. description of intended business operations in compliance with the SEZ type;
  2. land area required for intended operations of the applicant;
  3. estimated capital investments, including investments to be made within a year after the date of agreement.

Together with the application, the applicant submits the following documents:

  1. a copy of the incorporation certificate;
  2. a copy of the tax registration certificate;
  3. a copy of constituent documents;
  4. an investment project (business plan) approved by the applicant; this document must comply with the requirements set out in Appendix 1 to Order No. 75 "On Approval of Business Plan Forms Submitted to Conclude Production (Innovation) Agreements; Selection Criteria for Banks and Other Credit Institutions to Express their Opinion on Business Plans, Business Plan Assessment Criteria to Be Applied by Expert Panel on Innovative Special Economic Zones" issued by the Russian Ministry of Economic Development on March 23, 2006, and include a time-limit for filing project documents and engineering surveys to be audited by the deferal authorities;
  5. an unqualified opinion on the business plan expressed by the credit institution which will finance the project;
  6. an extract from the state register of legal entities issued by the tax authorities;
  7. documents confirming availability of proprietary funds (at least 20% of the investment project costs broken down by project year).

Within thirty calendar days after receipt of the above mentioned documents, the respective SEZ governing body makes a positive or negative decision to conclude an agreement with the applicant.
